NOTICE OF PROPOSED ORDINANCE

Notice is hereby given that the following Ordinance shall be acted upon by the Council of the Borough of West Mayfield at the regular business meeting on December 10, 2025, at 6:00 p.m. in the Council Chambers for West Mayfield Borough, located at 4609 West 8th Avenue, West Mayfield, Pennsylvania.

AN ORDINANCE REQUIRING LICENSING AND OCCUPANCY PERMIT(S) FOR ALL RENTAL UNITS OF ANY SIZE

Section 1. Definitions.

Section 2. A. Requirement for all owners of rental properties within the Borough to comply with this ordinance for the purpose of keeping the property in good and safe condition providing that the owner shall be responsible for the conduct and activities of occupants of their rental units.

Section 2. B. Requiring the designation of a manager for rental unit(s) for owners who are not natural persons.

Section 2. C. Requiring that all occupants of rental units shall be informed by the owner or manager of their contact information and also providing the same to the code enforcement officer.

Section 2. D. Requiring the owner to maintain the rented premises but also providing that the same may be designated to the occupants of the same.

Section 2. E. All rental agreements must be in writing. Any such rental agreement may not provide for a waiver of the occupant’s rights under this ordinance, and the owner shall attach a copy of said ordinance to every rental agreement.

Section 2. F. through J. Owner shall be directly responsible for the behavior of all occupants and guest(s) in any common area as if the owner were an occupant. Provide that in the event that an occupant commits their third disruptive conduct violation within one year, the code enforcement officer shall direct the owner to evict said tenant. Requiring owner to take the necessary action upon being informed of a code violation by the code enforcement officer.

Section 3. A. through I. Requiring occupant to comply with all applicable portions of the ordinance and also requiring a limitation on the maximum number of persons within a common area. Also requiring occupant to dispose of rubbish or garbage and other waste in a prescribed manner from the rental unit. Requiring occupants to conduct themselves to ensure peaceful and quiet enjoyment within their regulated rental unit. Requiring occupants to use their regulated rental unit only for residential purposes and not to engage in any illegal activity and refrain from disruptive conduct.

Section 4. A. Requiring owners and/or managers to file an annual registration of the rental unit with the Borough and to obtain a rental occupancy permit effective for the term of the tenancy, which shall not be transferable unless notice of a change of ownership as provided to the code enforcement officer.

Section 5. Statement of the grounds for nonrenewal, suspension or revocation of the license.

Section 6. Statement of basis for violation of the ordinance and penalties for the same.

Section 7. Miscellaneous provisions.
